Terms & Conditions - Nainital Willows

1. Booking, Rates & Payment

• Rate Validity: Quoted rates are valid for specified dates and programs. Seasonal surcharges may apply during peak periods.
• Payment: Full payment (100%) is required in advance for jungle safari and resort bookings.
• Payment Methods: Payments can be made via [specify accepted methods, e.g., bank transfer, UPI, credit/debit card]. Contact us for details.

2. Check-In, Check-Out & Transfers

• Check-In: 2:00 PM. Early check-in is subject to availability and may incur additional charges.
• Check-Out: 11:00 AM. Late check-out is subject to availability and may incur additional charges.
• Transfers: Must be requested at least 24 hours in advance. Same-day transfer requests are subject to availability and cannot be guaranteed.

3. Identification Requirements

• Foreign Nationals: Valid passport and visa required at check-in.
• Indian Nationals: Valid government-issued ID (Passport, Driving License, Voter ID, or PAN Card) required at check-in.
• Note: Guests must carry original IDs; photocopies or digital copies may not be accepted.

4. Cancellation & Amendment Policy

• Jungle Safari Bookings: Non-refundable once confirmed.
• Resort Bookings:
  • More than 35 days before arrival: 20% cancellation charge.
  • 22–35 days before arrival: 30% cancellation charge.
  • 8–21 days before arrival: 60% cancellation charge.
  • 7 days or less before arrival: 100% cancellation charge.
• Special Dates: Bookings during Christmas, New Year, and long weekends are non-refundable.
• Amendments: Changes requested within 35 days of arrival are treated as cancellations and subject to the above charges.
• Refund Process: Refunds, if applicable, will be processed within [specify timeframe, e.g., 7–14 business days] to the original payment method.

5. Child & Extra-Adult Policy

• Children under 5 years: Complimentary, no additional charge.
• Children aged 5–12 years: Charged at 25% of the adult rate.
• Guests over 12 years: Charged at 40% of the adult rate. A two-room upgrade is available for a supplement of 65% of the adult rate, subject to availability.

6. Park Closures & Force Majeure

• Park Closures: National parks may be closed on specified days, festivals, or due to unforeseen circumstances. Nainital Willows is not liable for closures beyond our control.
• Force Majeure: We are not responsible for disruptions due to natural disasters, government regulations, or other events beyond our control. Affected bookings will be rescheduled or refunded as per applicable government policies.

7. Liability & Guest Conduct

• Health & Safety: Guests are responsible for their own vaccinations, fitness, and health requirements. Nainital Willows is not liable beyond third-party insurance coverage.
• Conduct: Guests must comply with wildlife regulations, lodge rules, and safety guidelines. Non-compliance may result in termination of services without refund.
• Property Damage: Guests are liable for any damage caused to property during their stay.

8. Age Restriction

• Guests must be at least 18 years old to make bookings and participate in activities. By booking, you confirm compliance with this requirement.

9. Indemnification & Release

• You agree to indemnify, defend, and hold harmless Nainital Willows, its affiliates, and staff from any claims, losses, or liabilities arising from your participation, including negligence, to the extent permitted by law.

10. Media Release

• By participating, you grant Nainital Willows permission to use photos, videos, or other media captured during activities for promotional purposes without compensation.

11. Third-Party Links

• Nainital Willows is not responsible for the content, accuracy, or practices of external websites linked on our platform.

12. Governing Law & Dispute Resolution

• Governing Law: These terms are governed by the laws of India.
• Jurisdiction: Any disputes will be resolved exclusively in the courts of  Nainital, Uttarakhand, India.
• Dispute Resolution: For any concerns, please contact us before initiating legal action.
